Terms of Service

These Terms of Service ("Terms") govern your use of the Suppa mobile application and related services (collectively, the "Service") operated by Suppa ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You are responsible for all activity under your account.
  • You must notify us immediately of any unauthorized use.
  • We may suspend or terminate accounts that violate these Terms.

3. The Service

Suppa is an AI-powered meal planning application that provides:

  • **AI-assisted meal planning.** An AI assistant that suggests recipes and builds meal plans based on your preferences.
  • **Recipe management.** A recipe book for saving, creating, importing, and adapting recipes.
  • **Queue and scheduling.** A reorderable queue of planned meals.
  • **Grocery lists.** Automatically generated grocery lists derived from your queue, with manual additions.
  • **Cook Mode.** Step-by-step cooking guidance with timers and optional voice assistance.
  • **Shared plans.** Household collaboration on queues and grocery lists via invite links.
  • **Memory.** AI-managed notes about your preferences that improve recommendations over time.

4. AI-Generated Content

4.1 Nature of AI Content

The Service uses artificial intelligence (Anthropic Claude, Google Gemini, OpenAI) to generate recipes, meal plans, cooking instructions, and other content. AI-generated content is provided for informational purposes and convenience.

4.2 No Guarantees

**AI-generated content may contain errors, inaccuracies, or omissions.** Specifically:

  • **Nutritional information** is approximate and should not be relied upon for medical dietary needs.
  • **Allergy and dietary guidance** is best-effort based on your stated preferences. AI may not identify every allergen or cross-contamination risk. **If you have severe allergies or medical dietary restrictions, always verify ingredients independently.**
  • **Cooking instructions** may contain inaccurate times, temperatures, or techniques. Use your own judgment and standard food safety practices.
  • **Imported recipes** are parsed by AI and may contain transcription errors in quantities, units, or instructions.

4.3 Your Responsibility

You are solely responsible for reviewing AI-generated content before acting on it, including verifying ingredients, cooking temperatures, and food safety. We are not liable for any adverse outcomes resulting from reliance on AI-generated content.

5. User Content

5.1 Your Content

You retain ownership of content you create or upload ("User Content"), including recipes, feedback, notes, and conversation messages.

5.2 License to Us

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content as necessary to provide and improve the Service. This license terminates when you delete your content or account.

5.3 Content Standards

You agree not to submit content that:

  • Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Infringes any third party's intellectual property or privacy rights.
  • Contains malware, spam, or deceptive content.
  • Attempts to exploit, harm, or extract data from the Service or other users.

We reserve the right to remove content that violates these standards.

6. Shared Plans

  • **Invite links.** Shared plan invite links grant access to the plan. You are responsible for sharing links only with intended recipients.
  • **Shared data.** Members of a shared plan can see the plan's queue, grocery list, and member list. Your email may be visible to other plan members.
  • **Owner responsibilities.** Plan owners can manage membership and plan settings. Deleting a shared plan removes it for all members.
  • **Leaving a plan.** You can leave a shared plan at any time. Your personal data (recipes, preferences) remains in your account.

7. Voice Features

  • **Voice-assisted Cook Mode** uses third-party audio processing (OpenAI Realtime API). Audio is streamed in real time for processing and is not stored by us after the session.
  • You consent to audio transmission when you activate voice features.
  • Voice features may not be available in all regions or at all times.

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Reverse-engineer, decompile, or disassemble the Service.
  • Scrape, crawl, or use automated tools to access the Service beyond normal app usage.
  • Interfere with or disrupt the Service or its infrastructure.
  • Circumvent rate limits, authentication, or security measures.
  • Impersonate another person or entity.
  • Use the Service to develop a competing product.

9. Intellectual Property

  • **Our IP.** The Service, including its design, code, AI prompts, branding, and documentation, is owned by us or our licensors and protected by intellectual property laws.
  • **Your IP.** You retain ownership of your User Content (see Section 5).
  • **Feedback.** If you provide us with suggestions or feedback about the Service, you grant us an unrestricted, perpetual license to use that feedback without obligation to you.

10. Subscription and Payment

10.1 Free and Premium Tiers

The Service offers a free tier with usage limits and a premium tier ("Suppa Premium") with expanded access. The current feature entitlements for each tier are described within the app. We may adjust free tier limits or premium features at any time with reasonable notice.

10.2 Billing

Premium subscriptions are available as monthly or annual plans, billed through the Apple App Store. Subscription purchases, renewals, and cancellations are managed by Apple and subject to Apple's terms.

10.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription through your Apple ID account settings.

10.4 Refunds

Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.

10.5 Free Tier Changes

Features available on the free tier at the time you create your account are not guaranteed to remain free indefinitely. We will provide reasonable notice before moving free features to a paid tier.

11. Disclaimers

**THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.**

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • AI-generated content will be accurate, complete, or suitable for any particular purpose.
  • Defects will be corrected in any particular timeframe.

12. Limitation of Liability

**TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.**

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

**SPECIFICALLY, WE ARE NOT LIABLE FOR:**

  • Adverse health outcomes from following AI-generated recipes or dietary suggestions.
  • Allergic reactions resulting from AI-generated ingredient recommendations.
  • Food safety incidents resulting from AI-generated cooking instructions.
  • Data loss due to service interruptions or account deletion.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any third party's rights.

14. Termination

  • **By you.** You may delete your account at any time through the app. This terminates these Terms, subject to any provisions that survive termination.
  • **By us.** We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service. We will provide reasonable notice when possible.
  • **Effect of termination.** Upon termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy. Sections 4.3 (Your Responsibility), 5.2 (License, for content already in shared plans until deleted), 9 (Feedback), 11-13, 15, and 16 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations. **You agree to resolve disputes on an individual basis and waive any right to participate in a class action.**

Small claims court actions are exempt from the arbitration requirement.

16. General Provisions

  • **Entire Agreement.** These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • **Severability.** If any provision is found unenforceable, the remaining provisions remain in effect.
  • **Waiver.** Our failure to enforce any right or provision does not constitute a waiver.
  • **Assignment.** You may not assign these Terms. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
  • **Notices.** We may provide notices through the app or to your registered email address.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or sending an email. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service and delete your account.
